Ivan Barber, accused of pushing down an 84-year-old woman and stealing her purse, was indicted on charges of third-degree robbery, harassment and two counts of fourth-degree assault Thursday.
He also was arraigned for possession of methamphetamine in a separate case.
During his appearance, the prosecution moved to take Barber into custody with $5,000 bail on each case, saying that given the vulnerability of the victim, he was a danger to the community.
Barber, 22, of Woodburn, allegedly committed the robbery in the Rite Aid Pharmacy parking lot on March 21. At that time, he was free on his own recognizance regarding the methamphetamine case, which occurred on March 17.
And he was still free on his own recognizance Thursday. He was quickly released from jail on March 21 after the facility's matrix system, taking into account criminal history and new charges, suggested that he not be lodged.
Judge Locke Williams declined to put Barber in jail Thursday, noting that he showed up for court. Williams warned Barber that if he fails to appear, he will be arrested.
Medical issues also may have been a factor in Williams' decision. Barber, wearing a cast, said he needed to get a pin removed from his arm Friday.
Deputy District Attorney Christian Stringer declined comment for the most part about the judge's decision.
"I am so angry that I feel if I make a statement, it will just get me into trouble," he said.
When leaving the courthouse, Barber disputed some of the accusations. "I didn't kick her, and I didn't push her," he said.
